This website is usually accessible to users at any time. Some interruptions for maintenance purposes may be carried out by CEM-Vivant which will communicate time and date of said interruption to users.

The website is regularly updated by LAVERNAUX Pauline. As such, legal mentions can be modified at any moment: they are nonetheless applicable to the user who is invited to refer to them as often as possible to take notice of them.

The website aims to provide information relating to the activities of our company on the theme of music generated by plants.

CEM-Vivant strives to provide information that is as precise as possible on our website Nonetheless, it cannot be held responsible for omissions, inaccuracies or deficiencies to do with the update of information whether it be by its own action or those of a third party that provides said information.

All information indicated on the website are provided for information purposes only and susceptible to evolve. Furthermore, the information featuring on the website is not exhaustive. It is provided subject to modifications made since its publishing.

          4. Contractual limitations on technical data

The website uses JavaScript technology.

The website cannot be held responsible for property damage relating to use of the website. Furthermore, the user of the website commits himself to access the website with new equipment that does not contain viruses and with a latest generation browser that is up to date.

          5. Intellectual property and forgery

CEM-Vivant is the owner of rights to intellectual properties or holds the rights of use to all elements accessible on the website, notably texts, images, graphics, logos, icons, sounds and software.

All reproduction, representation, modification, publication, adaptation of all or part of elements of this website, whatever the means or process used, is prohibited, except by prior written authorisation of CEM-Vivant.

All unauthorised exploitation of the website or any one of the elements it contains shall be considered as constituting forgery and shall be prosecuted in accordance with articles L.335-2 and following the Code of Intellectual Property.

          6. Responsibility limitations

CEM-Vivant cannot be held responsible for direct or indirect damages caused to user property during use of the website and resulting from the use of equipment that does not meet the specifications indicated in point 4 ore resulting from the appearance of a big or incompatibility.

CEM-Vivant can equally not be held responsible for indirect consecutive damages (such as loss of market or loss of a chance) as a result of use of the website

CEM-Vivant reserves the right to remove, without prior notice, any content placed in this space that would contravene legislation applicable in France, in particular the provisions relating to data protection. If necessary, CEM-Vivant reserves the right to question the civil and/or criminal responsibility of the user, most notably in the context of messages that are racist, insulting, defaming, or pornographic in nature, regardless of the medium used.

In France, personal data is protected notably under law n° 78-87 of January 6th 1978, law n° 2004-801 of August 6th 2004, article L. 226-13 of the penal Code and the European directive of October 24th 1995.

While using the website, can be collected: the URL of links by the intermediary of which the user has accessed the website, the access provider of the user, the internet protocol (IP) address of the user.

In any case, CEM-Vivant only collects personal data relative to the user for the need of certain proposed services by the website The user provides this information in full knowledge of facts, notably when these are entered by the user. It is then stated to the user of the website whether the provision of this information is obligatory.

In accordance with the requirements of articles 38 and following the law 78-17 of January 6th 1978 relating to computers, files and liberties, all users dispose of the right to access, rectify and oppose any personal data concerning them, by making a written and signed demand accompanied by an identification copy with signature of the owner, and indicating the address to which a response should be sent.

No other personal information of the user of the website is published unbeknownst to the user, exchanged, transferred, conceded or sold on any medium whatsoever to any third party. Only the hypothesis of the repurchase of CEM-Vivant and its rights would permit the transmission of said information to the eventual acquirer who would in turn be held to the same obligation of conservation and modification of data towards the user of the website

Databases are protected by the provisions of the law of July 1st 1998 which transposes directive 96/9 of March 11th 1996 relative to judicial protection of databases.

The website contains a certain number of hypertext links towards other websites, put in place with the authorisation of CEM-Vivant. Nonetheless, CEM-Vivant does not have the capability to check the content of said sites, and will not assume the responsibility of said content.

Navigation on the website is susceptible to trigger the installation of cookies on the computer of the user. A cookie is a small file, that does not allow the identification of the user but that records information relative to the navigation of a computer on a website. The data obtained in this way aims to facilitate subsequent navigation of the website and have the added job of permitting the measuring of visits.

All litigation in relation to the website is subject to French law. The exclusive place of jurisdiction is the competent tribunal of Vesoul.
